The NPDES program regulates discharges to Waters of the US (WOTUS). Under the current definition of WOTUS, many projects that disturb an acre or more will no longer discharge stormwater runoff to WOTUS and therefore should not be required to seek coverage under a Construction Stormwater Discharge Permit.
